1. Acceptance of Terms

By accessing or using the ChatKing application (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to update or modify these Terms at any time, and your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. 2. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to terminate accounts where the user does not meet this requirement.

3. Prohibited Conduct

You agree not to engage in any of the following prohibited activities while using the Service:

• Harassment — bullying, intimidating, threatening, or otherwise harassing other users.
• Explicit content without consent — sharing sexually explicit, nude, or otherwise inappropriate images or videos without the express consent of all depicted individuals.
• Impersonation — creating accounts or content that misrepresents your identity or falsely claims an affiliation with any person or entity.
• Illegal activity — using the Service for any purpose that violates applicable local, state, national, or international law.
• Spam and solicitation — sending unsolicited commercial messages, advertisements, or promotional content to other users.
• Automated access — using bots, scrapers, or other automated means to access or interact with the Service without our prior written permission.

Violation of these rules may result in immediate account suspension or termination at our sole discretion.

4. Intellectual Property

All content, trademarks, logos, and other intellectual property displayed on the Service are the property of Paul Auerbach or its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent. By uploading content to the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely in connection with operating and providing the Service.

5. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or reliability of any information provided by other users of the Service.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Paul Auerbach and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Service. Our total aggregate liability for all claims related to the Service shall not exceed EUR 100.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of der Bundesrepublik Deutschland, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Deutschland.

8. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice.
